Employee Relations Manager – Libstar / Cape Town

Reports to: Group Employee Relations Manager
Locatin: : Plattekloof, Cape Town


Purpose of the role:

The primary responsibility of the Employee Relations Manager is to provide professional human resources and employee relations advice including general legal advice, assistance and/or support to all the relevant stakeholders at the group and/or business unit levels.

Key Performance Areas:

  • Supporting the implementation of a human resources strategy to achieve overall business objectives.
  • Ensuring and driving and compliance with applicable employment legislation.
  • Implementation and/or review of human resources policies and procedures in accordance with the business objectives and compliance with applicable legislation.
  • Implementing and/or reviewing contracts, agreements and/or collective agreements to ensure compliance with business objectives and applicable legislation.
  • Facilitating employer-employee engagements, including meetings or consultations with trade unions on matters of mutual interest.
  • Managing and/or facilitating consultations related to business restructuring, including retrenchment processes.
  • Managing collective bargaining processes, including negotiations of wages and conditions of employment.
  • Managing and/or presiding over disciplinary, grievance and incapacity processes.
  • Managing dispute settlement processes at the CCMA or Bargaining Councils, including Conciliations, Mediations, Facilitations, Con-Arb’s and Arbitrations.
  • Preparing applications related to dispute settlement processes at the CCMA or Bargaining Councils, including applications for Condonation, Joinders, Substitutions, Variations, Rescissions, Postponements, Disclosure of information, Jurisdictional disputes and other preliminary applications.
  •  AssistingwithprocessesconductedbytheDepartmentofEmploymentandLabour,includingCompliance Audits, Inspections, Investigations, DG Reviews and Enforcement Proceedings at business unit level.
  • Assisting with the management of litigation processes, including evidence gathering, legal documents and witness preparation.
  • Facilitating and participating in consultations with legal representatives in litigation matters.

Qualifications and Experience Requirements:

  • Bachelor of Laws (LLB)
  • Post-graduate degree an advantage
  • At least five (5) years relevant experience in a legal and/or business environment
  • Good working knowledge of the applicable employment legislation (BCEA, NMWA, LRA, EEA, SDA, UIA,OHSA, COIDA and any other relevant legislation)
  • Practical experience with the CCMA processes
  • Guidance to legal representatives
  • Ideally, applicants should be qualified legal practitioners with experience in general litigation, as well as experience outside of the legal profession in commerce and industry

  • Ability to work under pressure
  • Computer literate (Microsoft Office -Word, Excel, PowerPoint & Outlook) ▪ Valid driver’s licence with own transport
